Terms of Service

Welcome to Art of Birdie. These terms keep things fair and clear for both of us. By using this site or placing an order, you're agreeing to them. They're written in plain English on purpose. If anything is unclear, just ask: malini@artofbirdie.com.

1. Who we are: Art of Birdie Studio is an independent art studio based in Glasgow, Scotland, operated by Malini Chakrabarty. "We", "us" and "our" mean Art of Birdie; "you" means the lovely person reading this.

2. Our products: We sell original art prints and a monthly subscription (Prana Mail). We do our best to show colours accurately, but screens vary. Small differences between the image on your screen and the physical print aren't a fault. Sizes are as listed on each product page.

3. Orders: When you place an order, you'll receive a confirmation email. That's when our contract begins. We reserve the right to cancel and fully refund any order in unusual circumstances (e.g. a pricing error or stock issue); if that ever happens, we'll tell you straight away.

4. Prices and payment: Prices are shown in GBP (with CAD/USD conversion at checkout). Payment is processed securely by Shopify Payments and its supported providers; we never see or store your card details.

5. Delivery: Delivery times and costs are set out in our Shipping Policy. The order is our responsibility until it's delivered to the address you gave us. Please double-check that address at checkout, as we can't be responsible for parcels sent to an incorrectly entered address.

6. Returns and refunds: Set out in full in our Return Policy. In short: 14-day returns for unwanted items, free replacement or refund for anything damaged or faulty, and your statutory rights under UK consumer law are never affected.

7. Prana Mail subscriptions: Prana Mail is a recurring monthly subscription billed at £8.99/month [+ international shipping fee if applicable] on the 1st of each month until you cancel. You can cancel anytime via your account or by email; cancellation takes effect before your next billing date. Months already charged and dispatched can't be refunded, except where the parcel arrives damaged or faulty. We may occasionally adjust the subscription price or contents. If we do, we'll give existing members at least 30 days' notice and you can cancel before any change applies.

8. Your account: Keep your login details safe. You're responsible for activity on your account. We may suspend accounts used fraudulently or abusively.

9. Intellectual property: All artwork, images, and text on this site are the original work of Malini Chakrabarty / Art of Birdie Studio and protected by copyright. Buying a print gives you the physical artwork to enjoy. It doesn't transfer reproduction rights. Please don't copy, scan, reproduce, or use our artwork commercially without written permission. 10. Kind conduct: We're a small studio built on care. We reserve the right to decline service in cases of abusive, harassing, or discriminatory behaviour toward us or our community.

11. Liability:  Nothing in these terms limits your statutory rights or our liability for anything that can't legally be limited. Beyond that, our total liability for any order is limited to the amount you paid for it. We're not liable for losses that weren't reasonably foreseeable.

12. Privacy: How we handle your data is set out in our Privacy Policy. The short version: we collect only what we need to fulfil your order and (if you opt in) send our seasonal newsletter, and we never sell your data. Mother promise!

13. Changes to these terms: We may update these terms from time to time; the version on this page at the time of your order is the one that applies to it.

14. Governing law: These terms are governed by the law of Scotland, and any disputes are subject to the jurisdiction of the Scottish courts. (Though honestly — email us first. We fix things.)
